DB directives in PIL regarding Security of Courts

Jammu, July 19: In a Public Interest Litigation filed by Summit Nayyar seeking security of Court complex, A Division Bench of State High Court Comprising Justice Alok Aradhe and Justice Sanjeev Kumar after hearing both the sides observed that when the matter was taken up, learned Senior Additional Advocate General submitted that in compliance of the order dated 9.6.2017, a team of four additional traffic constables has been deployed to ensure vehicles of the advocates as well as litigants and general public are parked only in the parking space. However, he submits that some of the members of the bar association do not park their vehicles despite insistence of the traffic constables at the parking space. It is further submitted that in this regard communication has been sent by the Senior Superintendent of Police, Traffic City, Jammu to the President of the Bar Association of J&K, Jammu. The aforesaid communication is taken on record. Mr. B S Salathia, President of the High Court Bar Association, Jammu who is present in the Court states that he shall take all effective measures and use his good offices to ensure that the members of the bar association shall park their vehicles at the parking space which has been specially built for parking of the vehicles of the persons who visit this court complex.
Sr. AAG WS Nargal appearing for the state submits that an estimate of Rs.1.95 crores for construction of wall has already been prepared and has been sent to the Planning Department by the Law Department. The aforesaid proposal in turn has to be sent by the Planning Department to the Finance Department.
Upon this Division Bench directed Planning Department shall process the proposal forwarded by the law department within a period of ten days from today and shall forward the same to the Finance Department. On receipt of such a proposal, the Finance Department shall examine the same and shall disburse the amount required for construction of wall within a period of two weeks from the date of receipt of such a proposal and similar decision shall be taken with regard to installation of CCTV cameras and for release of the amount for construction of an alternate road as per the cost component already worked out by the R & B Department in the Comprehensive Security Plan which has been placed on record.
Division Bench further observed that in order to regulate the entry of the persons who visit the premises of the High Court, Mr. B S Salathia, President of the Bar Association, Jammu shall apprise this Court on the next date of hearing with regard to issuance of e-cards to the members of the bar association as well as suggest measures for regulating the entry of the litigants who visit the Court complex in connection with attending their cases.
