DB directs Tourism Secy to file affidavit failing which costs Rs 1 lacs be paid from his own pocket

JAMMU, Oct 4: Division Bench of the State High Court comprising Justice D. S Thakur and Justice Sanjay Kumar Gupta expressed its displeasure/ anguish over the lackadaisical approach of Commissioner/ Secretary to Government of J&K, Tourism Department who despite repeated communications from General Administration Department failed to submit his comments to the reply submitted by delinquent the then Chief Executive Officer, Rajouri Development Authority against whom departmental enquiry is pending in General Administration Department with regard to the irregularities committed during his tenure as Chief Executive Officer, Rajouri Development Authority.
Division Bench directed direct the Commissioner-Secretary to the Government, Tourism Department to render an explanation as to why the requisite comments had not been sent by him to the General Administration Department pursuant to various letters issued by it in that regard.
Division Bench also directed an affidavit be filed within a period of ten days from today. The Commissioner-Secretary to the Government, Tourism Department shall furnish the requisite comments in detail covering all aspects with reference to the charge-sheet served upon the delinquent officer and the reply submitted thereto by him. In case this order is not complied with, costs of Rs. one lac shall be imposed on the Commissioner-Secretary to the Government, Tourism Department to be paid by him from his person. He shall also appear before the Court on the next date of hearing at his own expenses.
After hearing Advocate Sheikh Shakeel Ahmed with Advocates Rahul Raina, Suraj Singh and Supriya Chouhan appearing for the petitioner whereas Senior AAG Seema Shekhar appearing for GAD, the Division Bench in the open court directed the Commissioner /Secretary to Govt. of J&K, General Administration Department to finalize the departmental enquiry within four weeks from today. The Division Bench further directed that in case Commissioner/Secretary to Govt. of J&K, Tourism Department failed to file his affidavit within 10 days explaining his conduct, in that eventuality he shall remain personally present on the next date of hearing at his own expenses. The Division Bench also directed the Tourism Secretary to file detailed point wise reply to the GAD as sought vide various communications since May, 2017.
Senior AAG Seema Khajooria Shekhar appearing for GAD submitted that because of non cooperation by the Tourism Department the enquiry could not be finalized. The Senior AAG produced before the Division Bench the copies of the various reminders sent to the Tourism Department evoking no response till date. The Senior AAG however assured the Division Bench that the departmental enquiry will be finalized on receipt of comments from the Tourism Department. JNF
