DB directives in Contempt regarding facilities for cancer patients

JAMMU, Jan 10: In a contempt petition filed by AV Gupta in public interest litigation regarding direction to the State to provide basic health facilities for treatment of cancer in the State of Jammu and Kashmir and also to provide adequate number of oncologists, Oncosur geons, PET scan machines and all other experts in the relevant field for the treatment of various types of cancer in all the regions of the State of Jammu & Kashmir.
A Division Bench of State High Court Comprising Chief Justice Badar Durrez Ahmed and Justice Sanjeev Kumar observed that Dr Pawan Kotwal, Principal Secretary to Government, Health and Medical Education Department is present pursuant to the direction given by this Court on 15.12.2017. He submits that the PET/CT machine has been already installed at Sher-e-Kashmir Institute of Medical Sciences (SKIMS) in Srinagar and is ready for commissioning. The medical staff is also in place. However, insofar as Jammu is concerned, the equipment has not yet been procured because the project itself has not yet been sanctioned by the Government of India and the funds have also not been released. Upon this Division Bench directed the progress in this matter be expedited and the latest status be furnished to this Court.
DB further asked ASGI Sindu Sharma to ensure that this proposal from the State Govern ment is expedited from the Government of India, Ministry of Health and Family Welfare and she shall also file the status report with regard to that, before the next date of hearing.
DB also asked Sr. Advocate DC Raina on behalf of the Public Service Commission shall inform this Court with regard to the post which was referred to the Public Service Commission as far back on 16.3.2011 and shall also ensure that the whole process is expedited. JNF
