Legislature passes Bill to raise salaries of Chief Justice, Judges of JK High Court

Salary of CJ to be enhanced from Rs 90000 to Rs 2.50 lakh, Judges’ from Rs 80000 to Rs 2.25 lakh; Bill for establishment of JK’s first National Law University also passed

JAMMU, Feb 12: The Legislative Assembly today passed 37th Constitutional Amen-dment Bill 2018 to raise the salaries of the Chief Justice and Judges of the Jammu and Kashmir High Court.
Explaining the statement of objects and reasons of the Bill, the Minister for Rural Development, Panchayati Raj, Law and Justice, Abdul Haq Khan, who moved it in the House, said that Parliament has amended High Court and Supreme Court Judges (Salaries and Conditions of Service) Act 1954 thereby revising the salary and pension and family pension in respect of Judges of High Courts with effect from 01-01-2016.
The Minister said by enacting High Court and Supreme Court Judges (Salaries and Condition of Service) Amendment Act, 2018, the Salary of the Chief Justice of the High Court has been enhanced from Rs 90000 per mensem to Rs 2.50 lakh per mensem and salary of Judges of the High Court has been enhanced from Rs 80000per mensem to Rs 2.25 lakh per mensem with effect from 1 January, 2016.
The Minister said that the bill seeks to enhance the salary of chief Justice and Judges of High Court to bring them at par with their counterparts in other States. He said the State constitution is proposed to be amended accordingly.
MLA Khanyar Ali Mohammad Sagar and MLA Pahalgam Altaf Ahmad Wani spoke on the Bill.
The Bill was later also passed by the Upper House also where it was moved by Minister for Rural Development, Panchayati Raj, Law and Justice, Abdul Haq Khan.
The Legislative Assembly today passed a Bill for establishment of maiden National Law University in Jammu and Kashmir.
The Bill was introduced in the House by the Minister for Rural Development, Panchayati Raj, Law and Justice, Abdul Haq.
Explaining the statement of objects and reasons of the bill, the Minister said that the proposed University once established will give a boost to the quality legal education in the State and the students will be benefited a lot.
The Minister said it has been resolved in All India Law Ministers Conference of National Law School University at Bangalore for improving quality of professional legal education. He said various States have already enacted the law for establishment of National Law University.
Devender Singh Rana, Pawan Kumar Gupta, Ali Mohammad Sagar, Mian Altaf Ahmad, Nawang Rigzin Jora, and Aijaz Ahmad Khan suggested for referring the Bill to Select Committee for further debate and discussion while R S Pathania and Shah Mohammad Tantray supported the Bill.

The Legislative Assembly today passed a Bill to amend the Jammu and Kashmir Electricity Act-2010 to pave the way for setting up of J&K State Power Trading Company Ltd.
The Bill was moved in the House by the Deputy Chief Minister Dr Singh and after thorough discussion the House passed the Bill along with amendments through voice vote.
Legislators, Mubarak Gul, Nawang Rigzin Jora, Devender Singh Rana and Mohammad Yousuf Tarigami took part in the discussion and gave their valuable suggestions.
The Bill was later also passed by the Upper House also where it was moved by Minister for Rural Development, Panchayati Raj, Law and Justice, Abdul Haq Khan.
Legislative Assembly also passed a Bill to amend the Jammu and Kashmir Passengers Taxation Act-1963.
The Bill paves the way for transfer of Passenger Tax administration from the Commercial Taxes Department to the Motor Vehicles Department.
The Bill was moved in the House by the Minister for Finance, Dr Haseeb Drabu.
Explaining the statement of objects and reasons of the Bill, the Minister said that in 2011 a Committee was constituted to make recommendation on the modalities for transferring of administration of Passenger Tax from the Commercial Taxes Department to the Motor Vehicles Department. He said as per the recommendations of the Committee one Accounts Officer, 12 each of Motor Vehicle Inspector & Accounts Assistant and 9 Motor Vehicle Traffic Assistant were proposed for creation in the J&K Motor Vehicle Department.
He said that there will be reduction of 9 posts of Guards and 12 Inspectors in the Commercial Taxes Department.
Earlier the Bill was introduced in the Legislative Assembly by Minister for Rural Development, Panchayati Raj, Law and Justice, Abdul Haq Khan on behalf of Minister for Finance, Dr Haseeb A Drabu.
Assembly also passed a Bill to amend the Jammu and Kashmir Motor Spirit and Diesel Oil (Taxation of Sales Act, Svt.2005 (1948 AD).
The amendment Bill was moved in the House by the Minister for Finance, Dr Haseeb Drabu.
The Bill envisages bringing Air Turbine Fuel (ATF) and Natural Gas, presently out of the purview of SGST Act-2017, under the ambit of Jammu and Kashmir Motor Spirit and Diesel Oil (Taxation of Sales Act, Svt.2005 (1948 AD).
Explaining the statement of objects and reasons, the Finance Minister, said the move would ease out the business compliance as also reduce the cost of collection of these taxes and would also ensure that all petroleum products will fall under the single legislation.
Legislators, Devender Singh Rana and Nawang Rigzin Jora participated in the discussion.
After thorough discussions, the Bill was passed through voice vote.

Assembly also passed a Bill regarding J&K Protection of Interests of Depositors (in Financial Establishments) Act 2018.
The Bill is aimed at protecting the interests of the depositors in the Financial Establishments of the State.
Explaining the statement of objects and reasons of the Bill, the Finance Minister, Dr Haseeb Drabu said the existing Jammu and Kashmir Protection of Interests of Depositors (In Financial Establishments) Act lays down various measures for protection of interests of depositors in the Financial Establishments in the J&K State.
The Minister said that the proposed Bill intends to amend and update the laws on the subject, with better and stringent provisions, for protecting the interests of depositors in the Financial Establishments in the State.
Legislators, Mubarak Gul, G M Saroori, Devender Singh Rana, Mian Altaf Ahmad, Altaf Ahmad Wani, Ali Mohammad Sagar and Nawang Rigzin Jora took part in the discussion and supported the Bill.
