Eight years RI in minor rape case

JAMMU, Feb 16: Principal Sessions Judge Reasi S R Gandhi today awarded 8 years rigorous impriosnment and fine Rs 10,000 to Kewal Krishan S/o Krishnu R/o Samokh Tehsil and District Reasi.
Principal Sessions Judge Reasi SR Gandhi after hearing Public Prosecutor Rashi Baru for the state whereas Adv Rakesh Jeet Singh for the accused observed that On 1.9.2014 prosecutrix had gone in the jungle for grazing the cattle and in the afternoon when she was returning to her house, a calf strayed in the jungle and in order to retrieve the same she again went back in the jungle where accused was hiding himself. Accused confronted with the prosecutrix, gagged her month, took her with him and raped her in the night and thereafter, abandon her. After that prosecutrix reached to the house of her sister in the morning at about 6/7 and disclosed the incident to her who narrated it to her mother-in-law and thereafter, her parents were telephonically informed. The father of the prosecutrix reached there and took the prosecutrix to his house.
Principal Sessions Judge Reasi SR Gandhi further observed that It is generally observed that despite enacting the Criminal Laws (Amend ment) Act, 2013 providing stringent punishments and procedural reforms, situation has not improved as desired inasmuch as statics reveals that there is increase in such crimes. It indicates that malady lies somewhere else. It may be the ignorance or lack of proper education of the subject. It would not be wrong to educate the children about rape and things related to it. Some day they are going to learn about it and get the wrong idea and end up as rapist spoiling two families and further polluting the atmosphere of the society. So instead of making them learn by themselves they should be taught about its serious consequences and most importantly how to treat and behave with a woman. In view of the aggravating and mitigating factors as highlighted by both the parties, Court is of the considered opinion that the imprisonment for eight years shall sub-serve the ends of justice Accordingly, it is ordered that for commission of offence under Section 376 of RPC, the convict- Kewal Krishan shall undergo rigorous imprisonment for eight years and a fine of Rs.10,000/-.
