Court rejects application for release of cattles


JAMMU, Mar 5: JMIC, Bishnah Girja Shavan rejected the Application for the release of Cattles total nine in number under case FIR NO. 38/2018 U/S188, 467, 468, 471 RPC and section 3 of Prevention of Cruelty to Animals Act. Counsel for the Applicant contended that the Applicant is the owner of nine cattles which were seized by the police party of Bishnah Police Station in a false and frivolous case and the Cattles may be released in favour of the Applicant.
On the other side Prosecuting officer Pawan Preet Singh appearing for the State raised the objection that the applicant is not a Bonafide owner of the Cattles because applicant has not filed an FIR in regard to the missing of his Cattles in any Police station and in case the Cattles are released in favour of the Applicant there is every possibility of the Cattles being again smuggled which in turn hurts the sentiments of a particular community and Disturbs Peace and Communal harmony. Prosecuting Officer also contended that there are two accused person in this case one is from Anantnag District and the other is from Doda District who were plying the Cattles in the Truck in a very cruel manner and that too with a Forged and fabricated permission of District Magistrate.
After hearing both the sides JMIC rejected the Application and ordered the custody of cattles in favour of Gowshala.
