Plea of cattle release rejected in Bovine smuggling case

JAMMU, Apr 19: Judicial Magistrate First class, Bishnah Girja Shavan rejected the Application for the release of cattles seized by the Police of Police station Bishnah in case FIR NO.73/2018 U/S 188 RPC, Section 3 of Prevention of cruelty to Animals Act. Counsel for the Applicant Adv Sonika Motten submitted before the court that the Applicant is the owner of the cattles total two I n number which were falsely seized by the Police of Police station Bishnah and as such may be released in favour of the Applicant on superdnama. On the other side Prosecuting officer Pawan Preet Singh raised the objection that the Applicant has no locus standii to file this application because the applicant is not the owner of the cattles. The menace of Bovine smuggling is increasing day by day which poses a grave threat to communal harmony and in case the court releases the said cattles in favour of the Applicant there is every likelihood of the cattles being again smuggled which in turn encourge the confidence of the persons enaged in Bovine smuggling.
Prosecuting officer submitted before the court that the accused were plying the cattles without the authority of District Magistrate in a very cruel manner and as such appropriate orders may be passed in this regard and the cattles may kindly be released in favour of the GowShala till the legal claimant appears before the court. After hearing both sides JMIC, Bishnah rejected the Application for Release of cattles and orders the custody of cattles in favour of the Gowshala.
