DB directs JMC to take action against companies for installing unauthorized towers

JAMMU, May 21: In a Public Interest Litigation filed by Navyug Sethi a law student seeking direction to respondents to issue appropriate directions to all those Telecom companies to shift/re-locate their Mobile Transmitting Towers from the residential areas to such places/areas which have been specifically earmarked and specified for installation of Mobile Transmitting Towers as per the guidelines as on 10.4.2016 issued by the Jammu Municipal Corporation, within such time as may be determined by this Court so that the residents having their residential houses/ establishments are saved from suffering serious diseases like cancer, sleep disorders, fatigue, headache, memory loss, depression, hearing problems, joint pains, skin diseases, and even cardiovascular problems which are inevitable because of radiation emitted by these towers.
A Division Bench of State High Court Comprising Justice Alok Aradhe and Justice Sanjay Kumar Gupta after hearing Sr. Adv Sunil Sethi with Adv Sumit Nayyar for the PIL, took serious note and directed Jammu Municipal Corporation to take action against Companies whose mobile towers have been found installed unauthorizedly in accordance with law.
DB also directed JMC to file
compliance report.
When the PIL came-up for hearing Adv Sachin Gupta appearing for the JMC Sachin Gupta, submits before the Division Bench that he shall file the compliance report during the course of the day. It is further submitted that notices have been issued to the companies whose towers numbering 74 are installed unauthorizedly for its closure. It is further submitted that in response to the remaining towers which have been set up in violation of the guidelines laid down by the Jammu Municipal Corporation, the notices are being issued and an appropriate action shall be taken.
Adv Sandeep Gupta, Central Government Standing Counsel submits that Upon this Division Bench directed that he shall file a report within a
period of two weeks with regard to the action taken to ascertain the levels of radiations. JNF
