DB directives in Petition regarding dearth of staff in J&K Courts


Jammu, Jun 2: In a petition filed by Joginder Singh Bench secreatry of the High Court regarding dearth of staff at various level (i.e.) High Court and District Courts, Pay Anomaly in respect of officers and staff and promotional avenues to Law Graduate Readers of the High Court.
A Division Bench of State High Court Comprising Justice Dhiraj Singh Thakur and Justice Sanjeev Kumar after hearing Joginder Singh Bench Secreatry and Satinder Singh Joint Registrar, allowed the application filed by &K High Court Personal Staff Association to intervene in the matter. Division Bench after hearing both the sides observed that in terms of order dated 23.05.2018, respondents have filed affidavits indicating therein the outcome of the meeting that was held on 20.3.2018 in the office chamber of the Registrar General. The affidavit filed by respondent Commisisoner/ Secretary Law indicates that in as many as nine different agenda items were discussed and some decisions were taken.
DB observed that from a perusal of the affidavits filed, it is apparent that no final decision in the matter could be taken due to the failure on part of and the Principal Secretary to Govt., General Administration Department to participate in the aforesaid meeting.
DB further observed that be that as it is, decision on all the aforesaid nine items which were subject manner of discussion in the aforesaid meeting held on 20-03-2018 is required to be taken by teh respondents.
DB directed Commissi oner/Secretary Law and Principal Secretary to Govt., General Admini stration Depart ment to file separate affidavits indicating clearly as to what steps they have taken to take final decision on nine agenda items which were discussed in the meeting held on 20-3-2018, convened pursuant to the directions passed by this Court on 27-2-2018.
DB also granted four weeks time to Sr. AAG to file requisite affidavits with copy in advance to teh opposite side as also the intervener. It is worthwhile to mention here that earlier Division Bench directed Registrar General to hold a meeting with Commissioner/ Secre tary, Law, Justice and Parliam entary Affairs, Principal Secretary to Government; Finance Department and Commissioner /Secretary to Government, General Adm inistration Depart ment and resolve all pending issues, on priority basis.
