SPOs demand regularized as Constable in view of contribution in anti-militancy

Jammu, Jun 19: In a petition filed by Subash Chander Raina & other seeking regularized as Constables in view their contribution made in the aforesaid anti militancy operation, Vacation Judge of J&K High Court Justice Sanjeev Kumar after hearing Adv Inderjeet Gupta appearing for the petitioner, directed State respondents to pass a speaking order within six weeks from the date of receipt of copy of this order.
During the course of hearing Adv Inderjeet Gupta submitted that petitioners were engaged as SPO(s) on July 24, 2001 and May 26, 2010 respectively and are presently rendering their services in Police Station Ramgarh District Samba and they have participated in anti militancy operations on November 29, 2016 at chambalyal, Ramgarh District in which huge amount of arms and ammunitions were recovered. It is submitted that in similar circumstances respondent Nos. 4 and 5, who were also working as SPO(s) were regularized as Constables keeping in view their contribution made in the aforesaid anti militancy operation but the cases of the petitioners were not considered.
Justice Sanjeev Kumar observed that Adv Inderjeet Gupta further submitted that the petitioners will be satisfied if a direction is issued to the respondents to consider the cases of the petitioners for their regularization as Constables in view of their participation in anti militancy operation on 29.11.2016 on the analogy of respondent Nos. 4 and Keeping in view the above made submissions, the nature of the relief prayed for the issuance of notice to other side may not be necessary.
Upon this Justice Sanjeev Kumar disposed of petition at this stage by directing respondents 1 to 3 to consider the claim of petitioners for their regularization as Constables in view of their participation in the anti militancy operation conducted on 29.11.2016 at Chambalyal Ramgarh District Samba on the analogy of respondent Nos. 4 and 5 provided the case of the petitioners is identical and is at par with respondent Nos. 4 and ordered that a speaking order shall be passed within six weeks from the date of receipt of copy of this order.
