Cheque Bounce case: One convicted for 1 year imprisonment, Rs 3 lakh fine

JAMMU, Jul 16: A local court here convicted a man in a cheque bounce case awarding him one year imprisonment and directed him to pay Rs 3 lakh to complainant.
Court of Railway Magistrate Jammu Yahaya Firdous after hearing Adv Amit Sharma for the complainant Durga Food Industries whereas Adv Sourav Gupta for the respondent Sushil Kumar observed that Since presentation of the execution petitions till date, accused has been given enough opportunities to liquidate the amount agreed by the accused vide order dated 14.08.2014 and till now the accused only paid Rs. 1 Lac out of the cheques amount.
So far, the court order dated 14.08.2014 is concerned, by virtue of which the accused was supposed to pay the double the amount of the cheques given to the complainants, accused has blatantly refused to abide by the order dated 14.08.2014, therefore, this court has no option except to implement the order dated 14.08.2018 in view of the law laid down in the case law supra and accordingly accused is sentenced for imprisonment for a period of one year. The accused is further directed to liquidate the amount as agreed vide order dated 14.08.2014, in default accused shall further undergo imprisonment of one year. The accused is also imposed a fine of Rs. 3 Lacs, however, the payment of Rs. 1 Lac paid by the accused shall be adjusted against the fine and rest of the fine shall be paid to the complainant. The accused shall be sent to Central Jail Kot Bhalwal for imprisonment. JNF
