Rassana Murder Case: Question mark put on functioning of Naib Tehsildar beyond territorial Jurisdiction

>>>>PETITION AGAINST DISMISSAL ORDER LISTED TODAY IN HC

20/07/2018

Pathankot, Jul 19: Mr. A.K. Sawhney Advocate with Mr. Shiv Dev Singh Thakur Advocate and Anil Sharma Advocates a writ petition against the order of dismissal from service on behalf of Mr. Tilak Raj Head Constable. The writ petition is listed today for consideration. Mr. A.K. Sawhney Advocate levelled allegations that the dismissal from service order is without show cause notice, without enquiry, without providing documents including charge sheet, so much so the copy of dismissal order was also not given to Head Constable Tilak Raj.
It is only when an R.T.I. application was filed then the copy of the order was furnished. Mr.Sawhney Advocate also questioned the double standards while passing the impugned order of dismissal since Mr. Suresh Gautam the then S.H.O. Police Station Hiranagar was issued the charge sheet but not dismissed from service. Two enquiries were ordered i.e, one by A.S.P. Kathua and second by Addl. Dy. Commissioner Kathua both the enquiries
pertaining to Rassana enquiries of S.H.O. were shelved and put on hold so that S.H.O. as a witness may depose falsely against two police accused
persons and thereafter there is every likelihood to drop the charges.
Meanwhile the witness Naib Tehsildar was cross examined and Mr. A.K. Sawhney and others defence lawyers put a question mark on the functioning of the Naib Tehsildar beyond his territorial jurisdiction.
