Petition by 163 GRS, others challenging termination

HC issues notice to Principal Secretary RDD, DC Rajouri, Poonch

JAMMU, Aug 20: Justice Sanjeev Kumar of J&K High Court (Jammu Wing) in a writ petition filed by 163 Gram Rozgar Sevaks, Monitoring Information System, Technical Assistant and Data Entry Operator belonging to Rajouri and Poonch Districts challenging their termination has issued notices to the Principal Secretary Rural Development Department J&K Government, Deputy Commissioner Rajouri and Poonch, Assistant Commissioner Devel opment Rajouri, District Panchayat Officer Rajo uri, Assistant Com missioner Deve lopment Poonch, District Panc hayat Officer Poonch returnable within two weeks. The notices were accepted in the open court by Deputy Advocate General Arshad Majid Malik appearing for Rural Development Departm ent.
The State Counsel was directed to file reply within two weeks. However, Justice Sanjeev Kumar despite repeated submissions from Senior Advocate Jahangir Iqbal Ganai assisted by Advocate Ahsan Mirza did not stay the operation of the impugned Govt. order No.203-RD&PR of 2018 dated August 9, 2018 and also order No.SS/MGNREGA/ ACDR/2018-19/3309-33 dated 11-08-2018 issued by Secretary to Government Rural Development Department and Assistant Comm issioner Develo pment Rajouri as Deputy Advocate General A.M. Malik vehemently argued that all the 163 petitioners are backdoor appointees and engaged without any advertisement /selection process.
After considering the heated arguments advanced at the Bar by Senior Advocate Jahangir Iqbal Ganai with Advocate Ahsan Mirza appearing for 163 petitioners whereas Deputy Advocate General A.M. Malik appearing for RDD, Justice Sanjeev Kumar in the open court said that the prayer for interim relief shall be considered after two weeks.
After considering the submissions of both the sides Justice Sanjeev Kumar in the open court issued notices to the State Government which was accepted by Deputy A.G. A.M. Malik and the State Counsel was directed to file his reply within two weeks. However, the court did not stay the operation of the impugned Government order and observed that such prayer will be considered after two weeks.JNF
