DB issues six weeks notice in PIL against illegal Stone Crushers


JAMMU, Sept 13: In a Public Interest Litigation seeking direction to respondents to restrain the illegal operation of stone crushers in Doda, Division Bench of the State High Court comprising First Puisne Judge Justice Alok Aradhe and Justice Sanjay Kumar Gupta after hearing Adv Javid Iqbal, issued notice to Deputy Commissioner Doda, SSP Doda & Ors returnable within six weeks.
During the course of hearing Adv submitted that There are 12 Numbers of Stone crushers which are operating illegally and are on official record of the district administration and there are many more illegal stone crushers and are nowhere on the official record of the district administration till date. There unauthorised/illegal operation are not posing threats to the environment and ecology but also to the life and property of inhabitants of this area and there are every reasonable apprehensions this may eventually lead to a big natural calamity in near future. The construction of Bhaglihar dam is already in natural mechanism of eating away these rocks and has laid high effects on the micro-climate of this region with a characteristics features of cloud bursts and floods that has become common and are leading to massive landslides and causing destruction causing to life and property. These are illegally operating stone crushers at the behest of the respondent No 1-9, they have no permission/ licenses to run those stone crushers and are also quarrying illegally. That the illegal actions/ operations of these stone crushers has been number of times brought in to the notice of District administration through protests/ representation/ resolution from time to time, to the District administration but alas ! no action was taken against these illegally operating stone crushers till date and are still operating. The owners of these stone crushers are highly influential persons having the links with higher-up bureaucrats and politicians of the State who are running this business illegally and it seems as if are working under the patronage of the State.
Few of them were reported in national news papers. It is pertinent to mention here in the year 2015 Govt issued guidelines for registration and operations of stone crushers and hot/wet mix plants Vide order No. 104-IND dated 14-07- 2015 through this order NOC from some more Departments were to be obtained for operation of stone crushers/ hot/wet mix plants and subsequently, thereafter State Govt. Notified Jammu and Kashmir Minor Mineral exploitation and processing Rules 2017 Vide SRO -302 Dated 1907-2017 for regulation of Minor Mineral based units/ Stone Crushers and Hot/wet mix plains wiiereunder a license from Directorate of Geology and Mining for establishing/ operating these piants has been made mandatory. Accordingly all unit holder were asked to obtain licence under rules within stipulated time, the Directorate of Geology and Mining vide letter No. 449/MCC/DJM/MME and PR/17/2699-2700 Dated 28-07-201 7 issued direction to their Regional Offices that the operation of all minor mineral based units like crushers and hot/wet mixing plants, marble and granite cutting/ polishing/POP etc units shall be strictly o regulated under these Rules.
There was no response from any of the units, the Directorate of Geology and Mining vide office letter No. 449/MCC/DGM/MME and PR/17/35J 2-13 dated 22-08-2017 again issued directions to the Regional Offices that every operational minor mineral based plant shall obtain license within the .stipulated time as notified vide SRO -302 dated 19-07-2017.
