RASSANA MURDER CASE: 108th witness recorded; Sawhney cross examines incharge SIT

PATHANKOT, Dec 12: Pr. Sessions Judge Pathankot Dr. Tejwinder Singh recorded 108th witness of the Prosecution in Rasana Murder Case of Mr. Peerzada Naveed.
Mr. Peerzada Naveed was the Incharge SIT in Rasana Murder Case. Mr. A.K. Sawhney, Advocate one of the defence counsel cross examined Naveed.
Meanwhile Mr Sawhney moved an application in the J&K High Court on behalf of the victim of Rape Case allegedly committed by Mr. Talib Hussain a witness in Rasana Murder Case. In one of the Rape case pending before Sessions Judge Samba. A Bail application was finally argued and was fixed for judgment but several times adjourned for deciding the bail application. Whereas, instead of deciding the Bail application the Court granted the interim bail to rape accused. The said order was challenged before the High Court of Jammu Wing. Justice Mr. Sanjay Kumar Gupta after issuing notice in the cancellation of the bail application directed the trial court Samba not to pass final bail order. The case was listed but could not be heard till date and meanwhile the concerned Sessions Judge Mr. R.K. Wattal transferred from Samba.
Mr Sawhney realizing the undue delay in the High Court for hearing the cancellation of the bail application moved an application to withdraw the pending cancellation of the Bail application requesting the High Court to vacate the interim order and let the trial Sessions court Samba to decide the main application finally on due date fixed on 31-12-2018.
The Sessions Judge Pathankot may decide the whole case as the court is directed by Supreme Court to proceed day to day in the case. Almost all relevant witnesses of the prosecution have been recorded and there is no stay from the Punjab and Haryana High Court regarding the age determination of one of the accured Mr. Parvesh Raj. In case the judgment pronounced despite the pendency of the age determination Petition of Mr. Parvesh Raj will prejudice the case feel legal experts.
