DB closes PIL in RDA Scam

In a Public Interest Litigation filed in alleged Rajouri Development Authority, Scam, A Division Bench of State High Court Comprising Chief Justice Gita Mittal and Justice Sanjay Kumar Gupta closed the PIL. When the PIL came-up for hearing, Division Bench observed that status report dated 11 December, 2018 has been filed by Mrs. Seema Shekhar, Sr. AAG, whereby we are informed that the Enquiry Officer under cover of his letter dated 25th October, 2018 has submitted the enquiry report to the General Administration Department. It is further stated in the status report that the report stands examined at various levels in the Government Departme nt and the same has been accepted by the State Government.
Sr. AAG Seema Shekhar has also brought a copy of the report dated 25th October, 2018, wherein after enquiring into the allegations against Mohammad Javed Kha n, IAS (respondent No. 7 before us), the Enquiry Officer after detailed consideration has concluded thus:- "Therefore, in the light of above details, Shri Mohammad Javid Khan, IAS, the then Chief Executive Officer, Rajouri Dev.
Authority is not found involved in any criminal negligence and, therefore, charges against him needs to be dropped. However, competent authority may like to order Regular Department Action against other two officials as the undersigned was assigned to conduct enquiry against Shri Mohammad Javid Khan, IAS."
