Court awards 11 months imprisonment in attempt to forgery case

JAMMU, JAN 15: CJM Samba Ajay Gupta today awarded 11 months imprisonment to Sanjeev Kumar son of Subash Chander R/o Ward No. 8 Kathua Tehsil and District Kathua who was facing trial in attempt to forgery case.
CJM Samba Ajay Gupta after hearing Senior PO Anil Saini for the State after considering the application, the statement of the accused as well as the contents of the challan and the relevant documents, the statements of the witnesses recorded under section 161 of Cr.P.C as well as the statements of the witnesses produced before this court by the prosecution during the pendency of the challan. As the accused has made the volunteer confession before the court and has prayed for a lenient view to be taken in his favour. Thus the approach of the Court should be that the punishment imposed should be only to reform the accused and to make him understand that he should not repeat the offence in future. In the present case as the accused has made the confession voluntarily, thus a lenient view of the matter is taken in favour of the accused only to make him understand that he will not repeat the offence in future. More over this has been a first folly on the part of the accused as no previous conviction has been pleaded or proved against the accused. The accused is already remained in custody for the last eleven months and twenty five days, as he has failed to produce bail bond with surety and personal for releasing him on bail. Thus, on the basis of the confession made by the accused in the open court, the accused is convicted for the offence under section 420/511 of RPC. The accused is accordingly sentenced to undergo a simple imprisonment for the period of eleven months and is further sentenced to pay a fine of Rs. 4000/ and in the default of payment of fine the accused shall further undergo the simple imprisonment for a period of twenty five days.
