J&K HC Judges, appointments: SC collegium defers one, recalls another and remits other recommendation of then J&K HC Collegium

New Delhi, Jan 18: Out of three recommendations for appointment as Judges to Jammu and Kashmir High Court the Supreme Court collegium has recalled one of them, deferred consideration of another and sent back other to High Court. In August 24, 2017 the J&K High Court collegium had recommended three advocates for elevation as High Court Judges 1. Wasim Sadiq Nargal 2. Nazir Ahmed Beig and 3. Showkat Ahmed Makroo. Two names Wasim Sadiq Nargal and Nazir Ahmed were finalized by Supreme Court collegium on April 6, 2018 and were forwarded to the centre for approval. However, the Centre referred the names back for reconsideration.
With respect to Wasim Sadiq Nargal the collegium has sought more information from Centre- Department of Justice regarding the reasons for referring back his file and has deferred consideration of his name for the time being.
As regards the file of Nazir Ahmed Beigh, the Supreme Court collegium has now decided to recall its recommendation by accepting the Centre’s objection the collegium therefore resolved to recommend that the proposal for his elevation need not to be processed any further said the minutes of the meeting held on Jan 16.
The proposal of Showkat Ahmed Makroo, which was not forwarded by the collegium to centre on April 6, has now been sent back to J&K High Court by the Supreme Court collegium comprising CJI, Ranjan Gogai Justices Sikri and Ramana.
Infact now the only appointment that could be hopefully reconsidered is of Mr Wasim Sadiq Nargal, whose case would be reconsidered by the S Court Collegium after the Centre submits its report about his recommendations, rest of the two recommendations have been set at rest.
