Court rejects bail of two alleged JeI members

JAMMU, Mar 14: Sub Judge Spl. Mobile Magistrate Jammu SS Bali today rejected the bail application of Abdul Karim Nadvi and Jameel Ahmed S/o Bashir Ahmed R/o Bali Charana Bashir Gujjar Basti, Jammu alleged member of banned organization Jamat-e-islaami who were booked by the Police Station Peer Mitha under Unlawful Activity.
Sub Judge Spl. Mobile Magistrate Jammu SS Bali after hearing CPO Ashish Rathore with Senior PO Raj Kumar appearing for the state whereas Advs AK Razdan and AR Bhat for the accused persons observed that Prosecution invited the attention of the Court that since the accused are involved in case FIR No. 14/2019 u/s 10 ULAct as such, this Court lacks jurisdiction to decide the instant bail application in view of SRO 149 of 2019 dated 1st of March, 2019 whereby Law Secretary issued notification that in exercise of the powers conferred by sub-section 1 of section 22 of the National Investigation Agency Act, 2006, Govt. hereby notifies the Court of Additional District and Sessions Judge, TATA/ POTA Srinagar and 3rd Additional District and Sessions Judge TATA/ POTA Jammu as special courts for Kashmir and Jammu Provinces respectively for the purpose of trial of offences under the Unlawful Activities (Prevention) Act, 1967. With these observations Court rejected the bail application. JNF
