Court rejects bail applications of two in murder case

SRINAGAR, June 20: 4th Additional Sessions Judge Srinagar Haq Nawaz Zargar rejected bail applications Mohammad Waseem Bhat and Adil Bashir who were booked by the police station Srinagar in FIR No. 03/2019 P/S Harwan Srinagar Offence u/s 302,120-B RPC.4th Additional Sessions Judge Srinagar Haq Nawaz Zargar after hearing both the sides observed that on 25/2/2019, the deceased was left in an unconscious state by the applicants at his residence and thereafter he died in the house. It is alleged that accused/applicants had tortured deceased as such, he succumbed. On receiving this information, FIR 03/2019 u/s 302, 120-B RPC came to be registered against the accused persons/applicants.Court further observed that as per the police report, the investigation is going on and a further enquiry is still pending in the case and at this stage if the accused persons are admitted to bail, they will hamper the investigation and it also pass a wrong signal in the society and boost the morale of such culprits. Court further observed that so far as the case in hand is concerned , same is under investigation and infact the main thing i.e, FSL report is still awaited, drawing any inference at this stage is unwarranted and un-justified. With these observations Court rejected the bail application. JNF
