Court rejects bail in attempt to murder case

JAMMU, JUNE 25: Sub-Registrar Jammu Smriti rejected the bail application of one Ashwani Kumar S/O Late Munshi Ram R/O Peer Mitha, Jammu allegedly involved in attempt to murder case.
Court after hearing Altaf Hussain for the State observed that that the accused is involved in FIR No. 38/2019 U/S 307/341/RPC 4/25 A Act and he has been arrested by the police on 16-06-2019 and further observed that the accused is prima facie involved in commission of grievous and heinous offence U/S 307/341/RPC 4/25 A-Act. The submission made by the Counsel cannot be considered at this stage and same are to be considered at the time of trial. Court is of the conscious of the fact that merits of the case are not to be discussed while deciding bail application, but the allegations leveled against the accused are serious grave in nature. According to the medical report and he injured has vital injury as he has been stabbed in abdomen. Moreover till date the statement of injured has also not been recorded. In such circumstances, the accused is not entitled for any leniency of bail at this premature stage and if bail is granted to the accused, he will definitely temper the prosecution evidence and will jump over the bail. The allegations leveled against the accused person are serious and grave in nature as such, accused is not entitled for bail at this premature stage. Thus the present case falls under exceptional cases where judicial discretion cannot be exercised in favor of accused person.
In the present circumstances of the case, the accused is not entitled for concession of bail at this premature stage. JNF
