Aseem Sawhney delivers lecture on J&K Reorganisation Act 2019 to JKAS batch

Jammu, Oct 17: The training of newly selected batch of JKAS officers has started at the prestigious IMPA (Institute for Management Planning & Admini-stration & Rural Development) Jammu and about 263 young probationers were given marathon back to back sessions by various intellectuals, senior officers and faculty members.
The Advisor Mr Kurshid Ahmed Ganai Advisor to Governor J&K addressed the officers at Brig Rajinder Singh Auditorium of Jammu University first thereafter Mr Simranjeet Singh IAS, CEO SMVDSB addressed the elite officers besides others.
Today the first lecture was delivered by Mr Aseem Sawhney Addl. Advocate General of J&K High Court Jammu. After Mr Sawhney's session, the guest faculty was Mr Kuldeep Khoda, ex DGP and former Chief Vigilance Commissioner J&K.
Dr Reva Sharma the Director of IMPARD welcomed the panelist Mr Aseem Sawhney with flowers and Dr Sunita Zailpuri the Course Coordinator and Faculty of the J&K IMPA addressed the newly appointed officers of the administrative services and gave a brief introduction of the subject. She also introduced the guest faculty.
Mr Aseem Sawhney, Addl Advocate General who is also a visiting Guest Faculty of the J&K IMPA & RD was invited by the J&K Govt's - premier institute IMPA to deliver lecture in general on law and another in particular on governance and dispensation of justice.
In an over view lecture on the J&K Reorganization Act 2019 to the new batch of JKAS officers delivered by Mr Aseem Sawhney the other day, he dwelled on various facets of the Act. He said that they were the first batch of officers to understand and discuss the new Act of 2019 and they would be looked upon by others to make then understand the facets of the Act. 2019.
In a caveat he told the officers that since the matter was sensitive and sub judice before the Supreme Court of India so the discussion would only be regarding the road map ahead. He said that the Act of 2019 (Reorganisation act )is an Act to provide for the reorganisation of the existing State of Jammu and Kashmir and for matters connected therewith or incidental thereto.
The Act No. 34 of 2019 was presented on August 5, 2019 and Assented toon August 9, 2019 by the President of India
He explained that the very opening line of the Act prescribed for an appointed day which was Effective from October 31, 2019 Legislative history.
The Jammu and Kashmir Reorganization Act, 2019 is an act of the Parliament of India. It contains provisions to reconstitute the state of Jammu and Kashmir into two union territories, one to be eponymously called Jammu and Kashmir, and the other Ladakh. The act will come into effect on 31 October 2019. A bill for the act was introduced by the Minister of Home Affairs, Amit Shah, in the Rajya Sabha, on 5 August 2019. The bill was passed in Rajya Sabha the same day and was passed by the Lok Sabha on 6 August 2019. It received the President's assent on 9 August 2019.
The act reorganizes the state into two union territories, namely the eponymous union territory of Jammu and Kashmir, and that of Ladakh. While the former will have a legislative assembly, Ladakh will be administered by a lieutenant governor alone. The union territory of Ladakh will include the districts of Leh and Kargil, while all other districts will be accorded to Jammu and Kashmir. Out of the six seats allocated to the state of Jammu and Kashmir, one will be allocated to Ladakh and five will be accorded to the Jammu and Kashmir union territory. The High Court of Jammu and Kashmir will function as the common High Court for both the union territories.
The act provides that the administration of the Jammu and Kashmir will be as per Article 239 of the Indian constitution. Article 239A, originally formulated for the union territory of Puduchery, will also be applicable to Jammu and Kashmir said Mr Sawhney.
Initially as per Section 5 of the Act the present Governor will continue to be the LG for the Union territories f J&K and Ladakh. A lieutenant governor appointed by the president will administer the union territory of Jammu and Kashmir, which will have a legislative assembly of 107 to 114 members, with a tenure of five years. The legislative assembly may make laws for any of the matters in the state list except "public order" and "police", which will remain as the law-making powers of the union government. A Council of Ministers including a Chief Minister will be appointed by the lieutenant governor from the members of the legislative assembly, with the role to advise the lieutenant governor in the exercise of functions in matters under the legislative assembly's jurisdiction. In other matters, the lieutenant governor is empowered to act in his own capacity, who will also have the power to promulgate ordinances having the same force as acts enacted by the legislature.
