Court acquits six in attack on Police Station Case

JAMMU, JAN 21: Principal Sessions Judge Poonch Madan Lal acquitted six accused namely Asdullah S/O Ghulam Mohiu-ul-Din R/O Azmabad Mandi, Mohd Din S/O Lassa Khan R/O Rajpura, Riaz Attash, irdous Ahmed sons of Mohd Asadullah , Farooq Ahmed S/O Abdul Khaliq R/O Rajpura and Mohd Yaseen S/O Mohd Sarvar R/O PLera whereas general arrest warrants issued against Mohd Rafiq S/O Ghulam Mohd R/O Balani.
The brief facts of the prosecution case are that on 22-8-2008 i.e, on Friday accused persons with common criminal intention after the prayer of Friday started agitation in connection with handing over the land to the shrine Board, instigated 5/6 thousand people of the area and instructed the mob to move to the police station Mandi and Tehsil Office Mandi and attacked these offices with intention to burn both the offices and also attacked on the police officials, armed with Dandas,sticks, iron pipes and gallon of petrol started slogans when they reached near TCP Mandi where police tried to stop them but accused persons pushed the police officials and reached alongwith mob up to gate of police station where police again try to stop them but accused persons with intention of killing of police officials started pelting huge stones upon them and seriously injured the SHO Abid Hussain,Constables Gulab Mohd,Tariq Mehmood, Bashir Ahmed, Farooq Ahmed, Mohd Razaq, Charanjeet singh, Tariq Ahmed, Tariq Khan and HC Mohd Younis and encircled the police station for three hours and during this period they pelted huge stones on the tin roof of police station. As a result of which the glasses/mirrors of police station and the vehicles which were parked with the premises of the police station got damaged .
Thereafter accused persons namely Raiz Atash and Firdous Ahmed entered into the Tehsil Office from there they thrown out the chairs and accused Farooq Ahmed sprinkle the petrol on furniture articles and accused Asadulah gave a match box to accused Mohd Rafiq who burnt the furniture.
Accused Mohd Din and Mohd Yaseen also burnt the furniture etc.
Court after hearing both the sides observed that the investigators who have been produced by the
prosecution agency have failed to link the accused persons with commission of offence. Javid Akhter Inspector, Ashaq Hussain and Munir Hussian Shah have failed to pinpoint any role played by the accused persons in the commission of alleged offences.
All the witnesses have made the statement only that some of the accused persons were seen in the mob,mere presence of the accused persons out of 5/6 thousand people they cannot be linked with commission of offences. In the opinion of the court prosecution agency failed to prove the guilt of the accused persons beyond reasonable shadow of doubt.
