J&K Reorganisation Act-2019 and Syllabus for Higher Judicial Service inconsistent: Sawhney

JAMMU, Jan 21: Mr. A.K. Sawhney Advocate (Former President Bar Association Jammu) appealed to the U.T/ J&K High Court to change the syllabus for Higher Judicial Service exam which is being held in 2020 selecting candidates for Higher Judicial Services for the posts of Addl. Distt. and Sessions Judges directly amongst Lawyers.
Mr. A.K. Sawhney in an open appeal to High Court J&K urged to reconsider the syllabus after the Jammu and Kashmir Reorganisation Act-2019 that has come into existence vide notification dated 9th August 2019. The notification reads as follows..

New Delhi, the 9th August, 2019
S.O. 2889(E)._ In exercise of the powers conferred by clause(a) of section 2 of the Jammu and Kashmir Reorganisation Act, 2019 (34 of 2019), the central Government hereby appoints the 31st day of October, 2019, as the appointed day for the purposes of the said Act.

Out of Syllabus
The J&K constitution has been scraped and other laws like J&K Houses & shops rent control Act, specific relief Act etc stand abolished and Central Laws of India are made applicable therefore, it will of no use to study J&K Constitution other Laws which stands abrogated and repealed.
J&K Cr. Pro. Code is also repealed and instead of Ranbir Penal Code it is Indian Penal Code which is applicable to Union Territory of J&K w.e.f., 9th August. 2019. The Syllabus for the coveted exam is totally inconsistent with the new laws of the UT and will not be of any use to check the acumen of candidates, hence the syllabus deserves to be made in sync with the applicable laws to the J&K and Ladakh UTs.
