Court rejects bail in Gang Rape case

Jammu, Jan 27: 3rd Additional Sessions Judge Jammu Subash C Gupta rejected the bail application of Jagdeep Kumar age 24 years S/O Mela Ram R/0 Sharan Tehsil Gho Manhasan District, Jammu facing trial in Gang Rape case.
The allegations against the applicant/accused and other co- accused are that on 24.1.2017 at 4.30 PM, in pursuance of earlier hatched criminal conspiracy ,they did not allow the prosecutrix to get dropped from the matador having Reg. No JK02BE - 6885 at Udheywala Chowk. At the same, the applicant/accused - Jagdeep Kumar closed the door of the same. Simultaneously, other co-accused Neeraj Bhagat closed the glass panes of window of the vehicle. Thereafter, they took the vehicle on Marh road and at about 4.50 PM, accused No. 1 -Anil Kumar forcibly took her on the back seat of the matador and committed rape with her by forcibly opening her clothes. It is further alleged that instead of coming to her rescue the other accused remained silent spectators and were laughing at the relevant time of commission of rape by the accused - Anil Kumar with her.
3rd Additional Sessions Judge Jammu Subash C Gupta observed that present matter, gravity, heinous and seriousness of the crime committed of forcible sexual intercourse can safely be kept in the category of the afore referred offences as same has allegedly been committed against the minor girl. It is generally seen that the teenage girls , who, cannot defend themselves on account of their physical weakness becomes readily and easily victim of sexual crimes at the hands of habitual and hardened criminals, who are hell bent to disturb peace of law loving & abiding citizens of the organized society. Criminals of serious and heinous crimes like the one as involved of forcibly sexual intercourse with a minor girl are to be dealt with iron hands. Their liberty as generally claimed by them by taking the assistance of fundamental rights enshrined in constitution of India can safely be curtailed in the interest of society at large. I am hasten to add this can safely be done in order to keep peace, tranquility and law & order in the society. In view of all the discussion referred herein above, Court is of considered opinion that the applicant/accused -Jagdeep Kumar is not found entitled for bail . Accordingly, his prayer for release on bail is hereby refused being devoid of any ,merit. Application.
