Court rejects bail in NDPS case


REAI, FEB 1: Principal Sessions Judge Reasi Kamlesh Pandit rejected the bail application of one Mohd Javed from whose possession Reasi Police recovered 10 KG and register FIR NO 55/2019 Police Station, Reasi Offences under Sections 8/20/29 NDPS Act.
Principal Sessions Judge Reasi Kamlesh Pandit after hearing Public Prosecutor BS Bandral for the UT whereas Advocate D.K Tanhotra for the accused applicant observed that illegal trafficking and trade in Narcotic Drugs and Psychotropic substances has posed potential threat to the whole society as it is eating the very vitals of the society and the traffickers are spreading their tentacles to every nook and corner of the U.T of Jammu & Kashmir. This court cannot loose sight of the conduct and past record of the accused person and the quantity of the contraband he was possessing.
The release of accused person at this stage will definitely have its adverse affect on the society at large.
The drug traffickers like accused person are making young generations slave to the addiction and once a person becomes addicted his life as well as well life of his family members become spoiled, therefore, the release of such accused persons having criminal antecedents with regard to the same offences is not in the interest of justice. Therefore, while considering what has been discussed herein above and without going into the merits of the case, the accused person/applicant herein has failed to convince this court for his admission on bail.
With these observations Court rejected bail application. JNF
