Court rejects bail of alleged JeM Militant

Jammu, Feb 8: Special Judge Jammu Subash Gupta today rejected the bail application of one Bashir Ahmed Lone S/O Mohd Akbar Lone R/O Aglar Kandi tehsil Rajpura District Pulwama alleged JeM Millitant who was arrested by Lakanpur Police Station.
Police report revealed that on 12.9.2019 at 9.45 AM, a Truck having Reg No JK013E-2000 was intercepted by a naka checking police party, at Lakhanpur, on the basis of prior information of their source. On checking, one person driving the Truck and two others persons were found sitting, therein. On questioning, they disclosed their names as Shabeel Ahmed Baba, Obaid-Ul-Aslam & Jahangir Ahmed Perray. On the search of the vehicle, a bag was found containing four numbers of AK 56 Rifles and two numbers of AK-47 Rifles, six numbers loaded magazines, each containing 30 live cartridges.
The afore named persons were arrested on spot and the recovered arms and ammunition were also seized on spot. Besides this, Truck loaded with other material was also seized on spot. It further becomes apparent from the police report that in the course of custodial interrogation of the afore referred accused, they disclosed that they have been motivated by Bashir Ahmed Lone and Suhail Ahmed Dar to join militant organization namely-Jash-e-Mohammad. It was further surfaced on their interrogation that these two persons have links with a dreaded militant of the afore referred organization namely-Ashiq Nainegroo, who operates his militant activities from Pakistan. It was further divulged by them that the afore referred two persons are motivating the local Kashmiri youth to join the a fore named militant group. All this, is being, done in order to create Kashmir as separate Islamic State by disintegrating from the Indian State. Immediate after having such a disclosure, a team of police officers was deputed to Kashmir for their arrest. They were arrested and brought to P/S Lakhanpur. Their cell phones were seized for extraction of the call details and were sent to CFSL, Gandhi Nagar, Gujrat. It is further contained in the police report that all the five number of accused were interrogated by the JIC, Jammu. According to the police report, investigation is yet in progress. However, involvement of all the five persons for commission of offences under sections 38,39 UA(P) Act, 7/27 Arms act & 120-B of RPC was found.
Court after hearing APP Sanjay Kohli for the prosecution observed that in the present matter, there are specific and un ambiguous charges against the applicant/ accused that he and other co-accused are working as a module for carrying out terrorist activities of the militant organization namely Jase-e-Mohammad. It is further alleged that they are in active touch with the dreaded militant- Ashiq Naingeroo, operating the militant activities of the afore named organization from the Pakistan. In the course of investigation, a Samsung Mobile Phone was also recovered from him & accusation against the present applicant/ accused is serious, heinous, grave viz-a-viz security ,integrity and sovereignty of Union of India and of our Union Territory. With these observations Court rejected bail application.
