Reasi, Feb 14: Principal Sessions Judge Reasi Kamlesh Pandit rejected the bail application of one Kranti Kumar who was booked by the police in attempt to murder case.
According to the police case that a complaint in the concerned police station on 12.07.2019 that his brother namely Jagtar Singh and another person Chaman Lal had gone to attend the marriage of the daughter of one Balwan Singh where his brother Jagtar Singh and another person Chaman Lal were attacked by unknown persons with sharp edged weapons with an intention to kill them. On this basis, case under FIR No.9/2019 came to be registered in the concerned police station for the commission of offences U/S 307/323/34 RPC. During investigation accused/applicant herein was arrested on 17.01.2020 and thereafter other two co-accused were also got hold and other two co-accused persons are still at large and the weapon of offence has not still been recovered.
Principal Sessions Judge Reasi Kamlesh Pandit after hearing both the sides observed that accused person/applicant herein once released on bail would indulge in tampering with the evidence and also extending threats to the witnesses as well as the injured when his other two co-accused persons are still at large.
Also important piece of evidence i.e weapon of offence has not been recovered.
There in the given facts and circumstances the incarceration of the accused person, even if judicial, would be of no help to him because the injured as well as the accused party have rivalry with each other. With these observations court rejected bail application.
