POTA Court Jammu grants hears bail on Watsapp; grants bail In U.L.A case

JAMMU, Mar 29: Mr. Subash C. Gupta 3rd Addl Sessions Judge and Spl Judge for POTA/fast track court granted bail to one Masood Ahmed who was arrested by Police Station Kishtwar under various sections of Unlawful Activities Prevention Act.
The Court considered the application virtually; through watapp wherein the application was moved by A.K. Sawhney Advocate with Mr Akeel Wani Advocate under present circumstances of lockdown as per guidelines laid down by the High Court of J&K.
Mr. A.K. Sawhney Advocate alleged in the application that Accused Masood Ahmed was arrested in a false and without any evidence in the case of F.I.R in the offences 13, 18, 19, 38, 39 under U.L.A.
Mr Sawhney urged that accused was arrested on 28th Sept. 2019 and 90 days expired as per section 167 cr. p.c. for producing challan but police failed to collect the evidence and as per section 43 D of Unlawful Activates Act read with 167 cr. p.c and its sub clauses the court may extend the investigation period upto 90 days more means total 180 days which completed on 28th March therefore the further remanded is illegal and unwarranted. The report was summoned on Whatsapp from DY.S.P. Kishtwar and appropriate reply was sought from APP after going through the record and all circumstances the Court after considering the provisions of law, granted bail on furnishing personal bond of RS 1 lakh and surety bond of like amount.
