Reasi Court rejects bail in Gang Rape case

JAMMU, JULY 8: Principal Sessions Judge Reasi Kamlesh Pandit rejected the pre-arrested bail applications of four namely Shah Din, Tariq Ahmed, Nasir Ahmed and Wazir Hussain who were allegedly involved in Gang Rape case.
Principal Sessions Judge Reasi Kamlesh Pandit observed that In this case complainant lodged a written report in the concerned police station on 30/06/2020, in the company of her husband that amongst the accused persons namely Shah Din and Tariq Ahmed have committed gang rape on her with the proactive facilitation of other two accused persons.
It has been further pleaded in the complaint that the accused person namely Nasir Ahmed also tried to outrage her modesty whereas another accused person namely Wazir Hussain was making the video of the incident and by virtue of that video she was forced to submit her person to the accused persons for more than two months and due to which her relations with her husband was about to be broken, but she revealed whole true story to her husband. The complainant /prosecutrix revealed in her complaint that due to the humiliation and pain with her person at the hands of accused persons, she had also thought to committing suicide.
She was threatened by the accused persons and was offered a bribe of Rs.1 Lac for putting the whole incident under the carpet but she denied to compromise with her honour and respect.
One more allegation was levelled against the accused persons that they were forcing her to get converted to their religion.
On this complaint, case under FIR No.27/2020 came to be registered against the accused persons for the commission of offences u/s 452/376-D/511/109 IPC and the investigation was set in motion.
Court after gone through the report observed that accused persons who have absconded from the investigation are facing charges of gang rape which offence is very much against the society and against the person of the victim and leaves an indelible mental scar on the victim.
It leaves a festering wound on the soul of the victim that gives a sharp pain at unknown times. It is a mutilation that affects the most visceral disgust of the self at most unsuspecting hours.
In fact , rape is a seed of trauma that unfolds in a victim's mind for rest of her life. Rape permanently alters a person's existence. With these observations Court rejected the bail application.
