HC stays trial Court order against Excise Commissioner

Jammu, Oct 14: In an appeal filed by Rajesh Kumar Shavan against order of 2nd Additional District Court whereby 2nd Additional District Court on October 12, 2020, held guilty Excise Commissioner for disobidence of Court, Justice Tashi Rabstan after hearing Sr. Adv Sunil Sethi with Adv SM Choudhary, Parimoksh Seth & Navyug Sethi, stayed the order of trial Court.
Justice Tashi Rabstan after hearing both the sides in length, issued notice to respondents, the notices were accepted by Adv Rahul Bharti for the respondents, directed respondents to file objections before next date of hearing. Justice Tashi Rabstan ordered that subject to objections from the other side and till next date of hearing only, the order impugned dated 12.10.2020 shall remain stayed and also summon the record from Trial Court.
During the course of hearing Sr. Adv Sunil Sethi, appearing for the appellant undertakes that the appellant shall issue transport permission in favour of the respondents forthwith. Let compliance report to this extent be filed by or before the next date of hearing.
