Centre must leave Legislative work for UT legislature: Harsh

JAMMU Oct 29: Accusing the BJP govt. Of imposing one law after the other upon J&K without any debate, discussion or deliberations at the appropriate forums, Mr. Harsh Dev Singh Chairman JKNPP and former Minister said that legislature was losing its relevance under the authoritarian central regime. With hundreds of new laws having been extended to J&K post Art 370 abrogation without following the prescribed legislative route and several others repealed without formal approval of legislature provided the most glaring example of abuse of position and authority by any regime, lamented Singh. He said that using sec 96 of J&K Re-organization Act to enact new laws and to repeal old laws without there being any exigency was not only violative of the rulings of the Apex court but also amounted to subversion of constitution besides contempt of legislature.
He called upon the BJP regime to leave the legislative work at least with respect to laws in the 'State list' for the UT legislature in case it ever intended to hold elections in J&K.
He was addressing a press conference in Jammu today.
Enacting hundreds of laws in quick succession without debates and deliberations by the bureaucrats, babus and clerks devoid of legislature's approval had not only created cynicism amongst the political parties but had exposed the highly casual and lackadaisical approach of the 'babus' framing such laws. He expressed dismay over the new provisions incorporated in Panchayati Raj Act in J&K UT making it a four tier system unheard in any democratic jurisprudence. While the rest of the States of the security have three tier system, J&K would have a unique four tier system with elected Panchayats in phase I, BDCs elections in phase II, DDCs elections in phase III and Chairpersons of District Councils in phase IV. Needless to mention that such kind of provisions do not exist anywhere in the country in any of the State/UT laws, asserted Singh.
Likewise, he said, the property tax law was enacted by the bureaucrats for J&K despite there being no exigency as the issue could very well have been examined and deliberated by the elected representatives once the legislature was constituted. There are several other new laws imposed upon J&K without giving any justification for the urgency to enact such laws without following the normal procedure laid down under the constitution. The new land laws bill has further aggravated tensions by allowing the outsiders to buy lands in J&K without having any domicile certificate, State subject or PRC.
The issue could very well have been left to the legislature for a thorough debate by discussing the pros and cons of the proposition so as to enable the elected representatives to take a final call which regretfully was not done. Not only that the law was in total contrast with the assurances given by the BJP regarding saving of lands and jobs of locals.
Mr. Gagan Pratap Singh, Mr. Parshotam Parihar , Mr. Surinder Chauhan and Mr. Gurdeep Singh were also present in the press conference.
