Court rejects bail in rape case

Jammu, Oct 31: Principal sessions Judge Reasi Kamlesh Pandit rejected the bail application of one Mohd Ayub Ayan who was booked by the P/S Mohore in rape case.
While rejecting the bail application, Court observed that there is no dispute that the accused person is involved for the commission of offence punishable under section 376 IPC. In this case prosecutrix in her statement u/s 164 Cr.PC has deposed against the accused person. The offence alleged to have been committed by the accused person is heinous and also against the society at large. The investigation in the case is under progress and taking into consideration the gravity and seriousness of the offence and the manner in which accused has committed the same on the person of a poor innocent woman who had sought some help from the accused, will leave an indelible mental scar on the victim.
Offence of rape leaves a festering wound on the soul of the victim that gives a sharp pain at unknown turns. In fact, rape is a seed of trauma that shall unfold in victim's mind for rest of her life. Rape permanently alters a person's existence. Therefore, in view of the above stated reasons I do not think accused person deserve discretion of this court at this stage. The net result of aforesaid discussion is that bail application of the accused/applicant herein deserves no concession and is accordingly rejected.
