Lawyers’ protest demanding reopening of court continues for 43rd day

Jammu, Nov 27: The agitation launched by the lawyers practicing in Jammu wing of J&K High Court and the Subordinate Courts since 15th of October, continued on 43rd day today. The lawyers Action Committee, carrying ahead the agitation held DHARNA in the Court Complex Janipura Jammu. The lawyers are protesting against continued closure of their entry into High Court completely and partially in Subordinate Courts besides no entry of public since March end this year. The lawyers are facing acute problems in performance of their professional duties whereas justice consumers are worst sufferers. In other spheres like Govt. offices, business, politics and elections, marriage gatherings, conducting proceedings of parliament and assemblies, cinema halls, liquor bars, bus and air transport etc functioning has been resumed since long. There is no genuine reason for keeping denial of entry to courts for unlimited period. Against this arbitrariness the Lawyers in Jammu had to launch agitation with the major demand of opening doors of courts and resumption of physical hearings in High Court and Subordinate Courts besides other demands for accepting hard copies, opening of closed Bar Rooms of lawyers and other facilities of lawyers in court complex, providing stamp papers and tickets in court area through stamp vendors, holding of elections for J&K Bar Council, opening of wound up consumer courts in J&K, shifting back Registration of documents from Revenue Officers to Judicial Officers, withdrawing contempt cases against some lawyers.
The charter of demands already projected by the lawyers include: Opening of all courts for physical entry to lawyers and public, resume physical hearing, Accepting hard copies of cases, Opening the locked Bar Rooms of lawyers, Providing stamp papers and tickets within court premises through stamp vendors, Immediately opening of Consumer Courts, Shifting back Registry of Documents to Judicial Officers, Withdrawing contempt initiated against the lawyers, Holding immediate election to the J&K Bar Council.
The participants in the Dharna expressed anguish over the new policy of authorities sitting in executive besides to some extent in judiciary for negating the role of lawyers in the justice delivery system. If not resisted, democracy and constitutional governance would suffer giving rise to dictatorship. They highlighted the lawyers' and public concerns due to continued closure of courts and the facilities of lawyers, besides shifting of Registry to Revenue from judicial officers. Many people are complaining of delays and corruption in the new system. Great hardships in tickets and stamp papers are faced by public and lawyers and also black marketing in it. After repealing of J&K Consumer Protection Act since August 2019, the consumer protection has been completely denied in J&K. Election to J&K Bar Council has never been held and power remains with High Court since its inception, this is denial of democratic rights to the lawyers and usurpation of their powers. Even directions of Supreme Court remain unimplemented. The Lawyers have compulsion to agitate when their voice is not heard by concerned authorities.
The LAWYERS ACTION COMMITTEE is committed to carry ahead the agitation till solution of issues raised.
