Court rejects bail of Militant supporter

Jammu, Jan 8: Special Judge NIA Sunit Gupta rejected the bail application of Nazar Hussain. Age 23 years S/O Said Ajam R/O Village Raipur. Tehsil and District Jammu alleged supporter of Militants.
According to the police case that Incharge P/P Chinore received the information from reliable sourc-es that one Nazar Hussain son of Syed Alam R/O Raipur Kheri Tehsil Jammu North District Jammu is indulged in unlawful activities. It was alleged that the aforesaid person is advocating, abetting, advising and inciting the unlawful activities and terrorist acts by way of social media and through his such activities he is assisting ANEs and terrorists. He is also allegedly in contact with dreaded militants of different banned outfits. He is also highly motivated to join the terrorist rank and is also indulged in motivating the youths to join the militancy. It is further alleged that the accused is abetting and also hatching a conspiracy to wage war against the Govt of UT of J&K and Govt of India. He is also circulating text, pictures/ videos and other incriminating material of militants and their supporters through social media like Facebook Instagram, WhatsApp and other platforms which is causing advantage to the foreign and local banned organization and also to individuals, who hell bent to weaken the unity integrity and security of UT of j&K and the country as a whole. His activities are glorifying terrorist acts and activities of enemy for the secession of J&K from the Union of India and he also intends to disrupt the sovereignty and territorial integrity of India. On the basis of the said information, prima facie the offences under section 13,18, UA{P) Act & 121/121-A IPC were found to have been made out against the present accused/applicant. As such, FIR No; 248/2020 under sections 13.18 UAfP) Act. 67 A IT Act 121/121-A IPC was registered with P/S Domana and the investigation was taken by DySP. SDPO Domana. During the course of investigation he had visited the village Kheri Raipur & conducted inspection and prepared site plan. The accused/applicant was arrested by him and recovered some photographs of the militants armed with weapons alongwith one mobile phone from his possession. The accused was shifted to Joint Interr-ogation Centre Jammu for sustained interrogation. During the course of interrogation the applicant/ accused had admitted his involvement in the commission of crime. He has admitted that he is highly motivated and willing to join the terrorist rank. It was also surfaced out during the interrogation that the accused is having close contact /association with the dreaded militants operating in Kashmir Valley. It is also mentioned in the report that since the accused has committed a sensational nature of crime, as such in order to prevent his activities necessary recommendation through dossier is being prepared and submitted to the competent authority for his detention under PSA.
Special Judge NIA Sunit Gupta while rejecting the bail application obser-ved that though, his contacts from PAK and POK have not yet facilitated him to join any Terrorist Group, but the fact remains that the applicant is desperate to join any Terrorist Group to wage the war against the government of India as well as the UT of J&K. With such kind of thinking and preparation of the applicant to join the Terrorist Group and to do militancy activities, It is felt that In case the applicant/accused Is allowed to be free from the custody, he would take no time to Join any Terrorist Group in order to wage war against the government of India as well as the UT of J&K. as such. It would not be In the Interest of nation to grant liberty to the accused/ applicant, otherwise. It would be against the interest of nation as well as the society at large.
