HC directs SSP Srinagar to secure presence of Director SKIMS; issues warrants

SRINAGAR, Aug 12: High Court Of Jammu & Kashmir And Ladakh At Srinagar comprising of Justice Wasim Sadiq Nargal has in case titled Dr. Sheikh Riyaz Ahmad and Ors. Through: Mr. Asif Wani, Adv. vice Mr. Altaf Haqani, Sr. Adv. Vs. State of J&K and Ors directed as follows:
"Vide order dated 27.06.2022, Ms. Asifa Padroo, learned AAG appearing on behalf of arguing counsel for respondents, was granted four weeks' last and final opportunity to file reply, failing which respondent no.3 would appear in person.
Despite last and final opportunity granted to the respondents, neither they have filed reply nor respondent no.3 has appeared in person in terms of aforesaid order, which left no option to this Court but to issue bailable warrants to the tune of Rs. 10,000/-, to be executed through Senior Superintendent of Police, Srinagar, to procure presence of respondent no.3 (Director SKIMS, Soura-Professor Parvaiz Ahmad Koul) on the next date of hearing. Ordered accordingly.
In the meantime, one more opportunity of one week is granted to the respondents to file reply, failing which right to file the same shall stand closed. The respondents while filing the reply shall specifically mention the reasons as to why they have not filed the reply till date inspite of the fact that the present writ petition is pending adjudication since 2014.
List on 27.09.2022.
Interim direction, if any, to continue till next date before the Bench.
Registry to supply copy of this order to Senior Superintendent of Police, Srinagar, for facilitating its compliance."
