Restaurant Functioning in Residential Area Challenged

Jammu: In a petition filed by MP Sharma challenging the functioning of Restaurant namely New Delhi situated behind Apsra Road Candhi Nagar which was operating in residential area without licence. In the petition, petitioner submitted that the functioning of restaurant in the residential area creates nuisance air/noise pollution disturbing private etc. He also submitted that the municipal authorities are informed time and again to close or seal the restaurant but they have not acted accordingly and petition came to this court. Justice Tashi Rabstan of J&K High Court Jammu Wing after hearing Adv PS Pawar appearing for the petitioner issued notice to Commissioner Jammu Municipal and ors returnable within two weeks and in the meantime court directed Commissioner Jammu Municipal Corporation to restrain private respondent from operating restaurant, if he is not possessing licence.
