Cabinet approves proposals to amend Labour Laws

New Delhi: The Union cabinet has approved proposal to amend to three archaic labour laws including the Factories Act 1948, Apprenticeship Act 1961 and Labour Laws (Exemption from Furnishing Returns and Maintaining Registers by Certain Establishments) Act 1988.
The amendments to the apprenticeship act 1961 is aimed at helping in skill development and training, providing flexibility to firms on hiring apprentices, pushing for induction of non-engineers as apprentices.
Labour Laws (Exemption from Furnishing Returns and Maintaining Registers by Certain Establishments) Act 1988 amendment will allow thousands of small industries to file just one return for compliance with a dozen or more labour laws, reducing the need for small firms to maintain registers. The definition of small establishments has also been proposed to be changed to firms hiring up to 40 employees, against 10 currently.
Labour and Employment Vishnu Deo Sai had earlier told the Rajya Sabha that Amendment of Section 66 of the Factories Act relates to permission for employment of women for night shift for a factory or group or class or description of factories with adequate safeguards for safety and provision of transportation till the doorstep of their residence.
This apart, amendment of sections 64 and 65 of the Act to enhance the limit of overtime hours from the present limit of 50 hours per quarter to 100 hours per quarter is also under consideration. The amendment also proposes this limit to be increased to a maximum of 125 hours per quarter in public interest with the approval of state government.
Prohibition of employment of pregnant women and persons with disabilities on or near machinery in motion and near cotton openers and reduction in the eligibility criteria for entitlement of annual leave with wages from 240 days to 90 days are part of the proposal.
