DB directives regarding constriction of lawyers chambers

Jammu: A much publicized Public Interest Litigatio regarding construction of lawyers chambers, parking and security of the Court, A Division Bench of State High Court Comprising Justice Dhiraj Singh Thakur and Justice Janak Raj Kotwal of J&K High Court observed that by virtue of earlier order, this Court had directed State to release a minimum of Rs 4 crores in favour of JKPCC within a period of two weeks to the date of order.
Division Bench after perusal of status report filed by Addiitonal Secretary law Dept in which it has been stated that the planning Dept vide dated May 5, 2015 has accorded sanction of earmarking of Rs 4 crores for constriction of the Lawyers's chamber at Jammu. However, the status report further reflected that only 50% of allocation i.e. 2 crore has been released by the Planning Dept in favour of law dept for the construction of Lawyer's chambers and the approach road.
Division Bench took serious note and observed that no reason have been given in the status report as to why despite clear orders from this Court and despite the sanction order, the entire amount has not been released in favor of JKPCC in compliance to the order passed by the Division Bench.
Sr. Adv DC Raina appearing for the JKPCC stated that no amount as yet has been released by the agency from the Govt, however, in anticipation of the receipt of amount as now reflected in the sanction order, the work has been initiated and is in full swing, Upon this division Bench observed that in the light of submissions, there appears to be no reason or logic as to why despite court orders, the Secretary planning has not released the amount in its entirety as ordered.
Division Bench further observed that another direction was passed earlier by this Court with regarding to sanctioning of an amount of Rs 50 lacs for the black topping of the road leading to the new parking area in Court complex, with a view to enable PWD to commence the work immediately thereafter.
On reading the status report, Division Bench observed that it appears that this part of direction has not been complied with too on ground that detailed estimate of work has yet to prepared for which matter appears to have been taken up with the Chief Engineer PWD.
Division Bench after hearing Adv Abhinav sharma appearing for the Bar Association Jammu, took serious note for not complying the court directions and directed Secretary Planning to comply the court order within a period of two weeks failing which he shall remain personally present on the next date of hearing.
