Court awards 8 years imprisonment in rape case

JAMMU, May 18: Principal Sessions Judge Kathua Vinod Chatterji Koul awarded 8 years imprisonment to Mohd Ayaz S/O Bashir Ahmad R/O Lohai, Morha Sarhali, Tehsil Billawar, District Kathua whereas acquitted Zarina Begum, Hanifa Begum and Mohd Hussain as no sufficient evidence to prove the charges against them.
According to prosecution case that father of prosecutrix lodged a complaint on 13.4.2014, he had gone to Katli for purchasing goods. His daughter (prosecutrix), whose age is 17 years, was at home alongwith other family members.
When he came back at 2.00/2.30 PM, his wife informed him that their daughter is not at home. They made her search, but till date could not locate/find her. Today they came to know that their daughter has been kidnapped by Mohd Ayaz S/O Bashir Ahmad in connivance and with the help of Mohd Hussain, Javid Ahmad, sons of Bashir Ahmad, Mst. Rashidi Begum Wd/O Bashir Ahmad, Mohd Jabbar S/O Mohd Hanief and Mohd Hafiz S/O Abdullah, all residents of Lohai.
Principal Sessions Judge Kathua Vinod Chatterji Koul after hearing both the sides observed that Mohd Ayaz shall undergo imprisonment for a period of eight years and fine of Rs. 50,000/- u/s 376 RPC and in case of default in payment of fine, he shall undergo a further imprisonment for one year.
He shall also undergo imprisonment for a period of three years and fine of Rs. 3000/- u/s 363 RPC and in case of default in payment of fine, he shall undergo a further imprisonment for three months. He shall also undergo imprisonment for a period of one year and fine of Rs. 1000/- u/s 344 RPC and in case of default in payment of fine, he shall undergo a further imprisonment for one month. However, all sentences shall run concurrently. The fine, if deposited, shall be given to the prosecutrix/victim as compensation. JNF
