2nd Addl. Sessions Judge seeks explanation of SHO for not serving warrants to witness

JAMMU, Aug 11: 2nd Addl. Sessions Judge Jammu Mr. Pawan Dev Kotwal directed SHO Trikuta Nagar to explain why the warrants issued by the court and served not upon Mr. Jaswant Singh witness. The process of the court is derailed by the such tactics of the police and disposal of the criminal cases is unduly delayed urged Mr. A.K. Sawhney Advocate counsel for the accused in the murder case title State v/s Vikram Singh Yashjeet and another.
Mr. A.K Sawhney Advocate urged before the court that speedy disposal is the Fundamental Right of the accused and it is no excuse with judicial institution that several cases are pending therefore the Fundamental Right of speedy disposal can't be implement. The court order reads ………….
'ORDER'
"1. From the perusal of record, it is revealed that PW Jaswant Singh did not cause
appearance despite due service as such, bailable warrants were issued against him, but, the warrants were not executed and on the last date i.e. 22nd of July, 2017, it was ordered that the SHO concerned shall execute the warrant and notice of the other witnesses. But from the perusal of report submitted by the concerned SHO, it is revealed that the warrants could not be executed because of incomplete address of the witness. Needless to mention here that the notice of the witness was served by the same police station and on the basis of report the concerned police station, the warrants carne to be issued by the court.
2. Therefore, office shall issue fresh warrants in terms of previous order and concerned SHO also owes an explanation. As such, office to issue notice to the concerned SHO to explain his position on the next date. Pws Dr. Ruchi Khajuria and Dr. Abhineet Suri be summoned through Director, Health Services for the next date. Accused be kept in judicial custody to be produced on the next date. Put up on 30.08.2017.
