2 years imprisonment to Pak National Woman

JAMMU, July 12: Prin-cipal Sessions Judge Jammu Vinod Chatterji Koul awarded two years imprisonment to Asma Fayaz Bhat D/o Mohd. Iqbal W/o Abdul Salam Bhat @ Fiaz Bhat, R/o Krachi, House No.SK14/37B, Khijrabad, P/O Kandi,Teshil and District Krachi.
Principal Sessions Judge Jammu Vinod Chatterji Koul after hearing Public Prosecutor Rakesh Badyal for the State observed that the evidence on record and also the admission of Asma Bhat in her statement recorded under section 342 Cr.P.C, being resident of Krachi Pakistan, the prosecution has thus, succeeded in establishing the charge i.e. commission of offence punishable under section 14-A Foreigners (Amendment) Act, 2004 against Asma Bhat. Therefore, it is held that prosecution has proved the charge against the accused Asma Bhat beyond doubt. As such, accused Asma Bhat is accordingly convicted for the commission of offence punishable under section 14-A Foreigners (Amendment) Act, 2004. 29. Punishment provided for the commission of offence under section 14-A of Foreigner (Amendment) Act, 2004 is imprisonment for a term which shall not be less than two years, but may extend to eight years and shall also be liable to fine which shall not be less than ten thousand rupees but may extend to fifty thousand rupees.
Court further observed that the accused is foreign (Pak) national, who had entered into Indian Territory without any valid permit and was found in restricted area/protected area, thus, violated the provision of section 14-A of Foreign (Amendment) Act, 2004. The accused No.3 Is a young lady of 39 years. Therefore, having regard to the circumstances of the case and her age, she is sentenced to undergo imprisonment for a period of 02(Two) years and shall also be liable to pay a fine of Rs. 10,000/- (Rupees Ten thousand only) and in case of her default to pay the fine, she shall further undergo imprisonment for a period of three months. Court further said that after completion of sentence necessary steps be taken for her deportation. JNF
