Court directives to SSP in killing of person at Farooq’s Residence

JAMMU, Aug 9: In a application filed by Imzad Hussain Shah father of Syed Murfad Hussian Shah who had been shot dead at Ex-CM Farooq Abdulllah Residence, seeking registration of FIR, Sub-Registrar Jammu Swati Gupta after hearing Adv Veenu Gupta for the applicant, directed SSP Jammu to take action as permissible under law.
In the application seeking registration of FIR, it has been submitted that on 04-08-2018 the Son of the applicant namely Syed Murfad Hussian Shah had gone to Bathindi in his vechile bearing no. JK02BW 0568 for unknown reasons, but the applicant only got the information regarding the death/ encounter of his son in a firing incident at Farooq Abdulla's (member of parliament) residence in Bathindi, Jammu.
That even though the son of the applicant has died but the F.I.R has not been lodged on behalf of the applicant for ascertaing the reasons behind the alleged firing incident but an F.I.R has been lodged on behalf of the CRPF personnel for the alleged trespassing into the highly security guarded VVIP residence.
It is has been further submitted that the story created by the CRPF personal for encounter of the son of the applicant is not only illogical but also completely unbelievable that despite the repeated request and the application to the S.H.O Trikuta Nagar and copy of which is also send to D.G.P, Law and Order, J&K Police and also to S.S.P Jammu but till date no F.I.R has been lodged by the aforesaid police officer to investigate the matter.
During the course of hearing counsel submitted that the applicant has also approached the aforesaid Police Officer with evidence (Photograph) of the vehicle of the deceased clearly showing tampering with the vehicle of the deceased which is the main evidence in the alleged commission of offence.
