Court rejects bail of two in 304

Jammu, Aug 11: Sub-Judge Jammu Kusum Pandita today rejected the bail application of Mohd Javaid S/o Mohd Sadeeq R/O Doongian Tehsil Jammu and Hardeep Singh S/o Bikram Singh R/o Nowabad, Jammu who was allegedly involved in 304 RPC (culpable homicide not amounting to murder).
Police report further transpires that on 09.06.2018 at Dongia near city hospital a dead body of Mohd Arif S/o Shamas Din was found on back seat of Alto Car No. JK02A 3705 in a suspicious condition on which inquest proceedings were initiated u/s 174 CrPC. During inquest proceedings, it transpired that deceased died due to intake of danbtal morphine tacixotninoi and it was further found that on 08.06.2018 the deceased left home with a vehicle which was seized and Makka Mazjid Chowk Mohd Javed @ Jallu S/o Mohd Sadiq r/o Dongian. Tehsil Bahu met him and deceased alongwith said Javed went to Zakir Hussain S/o Khursheed Ali R/o Bathindi in the same vehicle wherefrom a three went towards Chhani and on the way at Nowabad Mohd Javed took Heroine narcotic drug from Hardeep Singh S/o Bikram Singh R/o Nowabad Bathindi and all the three persons consumed said drug i.e. Heroine inside the vehicle at Dongian. The deceased also was given said narcotic drug i.e. Heroine in over dose and he was left in the vehicle and other two people fled away. They did noi inform anybody not took the deceased to hospital for treatment and deliberately administered over dose of Heroine to the deceased in order to kill him and they were having the knowledge that by drug overdose the person can die. On this FIR in question was registered.
Sub-Judge Jammu Kusum Pandita after hearing Senior PO Puja Nijhon for the State observed that the accused allegedly by indulging in supply and consuming of narcotic drugs have acted in a manner which has hurt the sentiments of the public in general and the family of the deceased in particular and moreover the offence committed by the accused is serious in nature and carries punishment of imprisonment for life. With these observations Court rejected the bail application. JNF
