Constitute Family Committees; implement SC judgment: Sawhney



Court directs SHO Women Cell Samba to implement SC Judgment, No arrests can be made without permission of Magistrate

Samba, Sep 13: Mr. A.K. Sawhney Advocate brought into the notice of the Distt. & Sessions Judge Samba Mr. R.K. Wattal that no arrest can be effected in offence under section 498-A and allied family matters S.H.O. Women Cell visited the shop of Rajinder Kumar Saini at Nanak Nagar, Jammu directing the family members to appear at Police Station Women Cell Samba on 13-08-2018 at 10:00 A.M. and bring Rs. 5,00,000/- (fifty lakhs) so the compromise be effected quickly. Mr. A.K. Sawhney advocate urged already got order of bail and anticipatory bail has been granted upto 12-9-2018 and report has been called from S.H.O Women Cell on 13-09-2018 date has fixed and report has been received alleging there that no F.I.R. registered against Rajinder Saini but S.H.O on 12-09-2018 while visiting shop of victims alleged that there is a case of theft against the family of Rajinder Kumar Saini.
The visit of SHOis recorded in CCTV camera how can SHOvisit shop and put pressure on theparty to coerce for settlement to pay Rs 50 lakhs. Mr. A.K. Sawhney Advocate read out the Judgement to the Court that there will be "Family Distt. Committee" of three members to which Distt and Sessions Judge will be the chairman who will examine family complaints and submit the report. However, no arrest shall be caused without prior permission of the Magistrate. It is only the Distt family committee who is authorized to communicate with the parties and medicate and finally submit the report, S.H.O. Women Cell has no role to play his or her wings are cut by the Supreme Court Judgment. In Samba there is no committee constituted. However the Distt.& Sessions Judge Samba directed S.H.O. Women Cell Samba to implement Supreme Court Judgment and forwarded the copy of Supreme Court Judgment alongwith its order.
Mr. A.K. Sawhney also pointed out that administrative action is prescribed against the Police Officer alongwith the contempt of court of the High Court as per Supreme Court Judgment and both actions are being initiated against the S.H.O. Women Cell alongwith proof of CCTV footage said Mr. A.K. Sawhney.
