HC issues bailable warrants of Com/Secy Forest Dept

Jammu, Jun 1: In a contempt petition filed by Gh. Hassan & Ors who are daiy rated workers in Forest Dept seeking implementation of Court directon whereby Courtr directed respondents to consider the cases of the petitioners for regularization in terms of SRO 64 of 1994 and pass appropriate orders with in four weeks.
Justice Sanjeev Kumar after hearing Adv Sudershan Sharma appearing for the applicants whereas Govt Adv Ayjaz Lone for the Stte, observed that neither the order dated April 8, 2019 has been complied nor Commissioner /Secretary present in person, issued bailable warrants of Commissioner/ Secretary Forest Dept to the tune of Rs 10,000 to be executed by SSP Srinagar through SHO of concerned Police Station. Justice Sanjeev Kumar observed that on April 8, 2019, this Court observed that the respondent Nos. 1,3, 4 and 5 have filed compliance report in which they have not denied the claim of the petitioner for regularization but have submitted that the case has been taken up with the Finance Department and as and when the approval is received by respondent No.1, formal orders of regularization shall be issued.
Court further observed that the fact remains that it is the responsibility of respondent No.1 to take up the matter with the Finance Department or some other department as may be required so that the judgment passed by this Court is complied with in letter and spirit. Counsel appearing for respondent Nos. 1,3, 4 and 5 submits that the case has come up for consideration after more than two years and it is because of this reason, he is not aware about the latest status of the case. Therefore, he seeks and is granted four weeks' time to come up with compliance, failing which Commissioner/Secretary to Govt., Forest Department shall remain present before this Court on the next date of hearing.
