Court rejects bail applications of two in DAG’s murder case

JAMMU, AUGUST 1: 1st Additional Sessions Judge Jammu YP Kotwal rejected the bail application of Gourav Sharma & Mohan Singh.According to the police case that The murder of Deputy AG Ajit Singh Dogar had taken place over a land-grabbing issue which the accused had sold to one HaqiqatRai by using forged documents. The deceased had filed a case against the accused on charges of fraudulently selling his land. On January 10, 2008, the accused had forcibly stopped the vehicle of AJitDogra after firing at his vehicle. They had attacked him with sharp edged weapons, leaving him seriouslyinjured.
He had succumbed to his injuries in a Delhi hospital.
Court after hearing APP Ajay Singh Manhas for the State observed that Apex Court has held that mere long period of incarceration in Jail would not be per-se illegal, if the accused has committed offence, he has to remain behind bars, auch detention in Jail even as an under trial prisoner would not be violative of Article 21 of the Constitution.In these circumstances the applicants, accused have failed to make out a case for grant of bail. Hence, these applications deserve dismissal and are accordingly dismissed. JNF
