Court award life-impriosnment in murder case

DODA, NOV 29: Additional Sessions Judge Doda Zabair Ahmed Raza awarded life-imprisonment to Javed Iqbal S/O Abdul Gani Butt R/O Shaleen Shamithi, Tehsil & District Doda who facing trial in murder case.
Court after hearing both the sides observed that Javed Iqbal is a young person and the imposition of sentence for life imprisonment would serve the interest of justice and that the present case does not fall in the category of rarest of rare case so as to the imposition of death sentence, which is of exceptional nature.
Keeping in view the age of the accused and considering the contention of learned defence counsel about the crime, I think this case does not fall in the category of rarest of rare case. Keeping in view the age of the convict, imprisonment for life shall be adequate sentence in the present case. Accordingly, convict /accused namely, Javed Iqbal S/O Abdul Gani Butt R/O Shaleen Shamithi, Tehsil & District Doda, is sentenced to undergo imprisonment for life and a fine of Rs. 30,000/- (rupees thirty thousand only) for offence u/s 302 RPC, in causing the murder of Abdul Rashid Giri. In default of payment of fine, accused shall undergo further imprisonment for six months. The sentence of imprisonment for life, however, shall be subject to confirmation by the High Court.
Accoridng to the police case that as the missing report has been registered, on 17.05.2007, complainant son of deceased alongwith Abdul Gani Manshoor again appeared in the Police Post, Kastigarh and presented a written application addressed to the Incharge, Police Post, Kastigarh, alleging therein that from 25.04.2007, his father was missing for which they have filed the missing report in the Police Post and after that they have tried to know the whereabouts of the missing person secretly. Now, he came to know that Javed Ahmed S/O Abdul Gani Butt R/O Shaleen Shamithi, Tehsil Doda, for the sake of money and greediness, has murdered his father, whose dead body has been kept somewhere in hidden position.
Further, it was wrote that some other people were also involved in this murder and it is requested that inquiry be conducted and legal action be taken against them. So, as per the written report of Jahangir Ahmed and on perusal of the contents of application, offence u/s 302 RPC seems to be taken place.
