Court awards 7 years RI in rape case

Jammu, Jan 24: Principal Sessions Judge Reasi Kamlesh Pandit today awarded seven years rigorous imprisonment and fine Rs 10,000 to Rakesh Kumar S/O Sheru Ram R/O Taryal Bhambla, Tehsil & Distt. Reasi who was facing trial in rape case.
Brief facts as disclosed by the challan are that on 18.07.2011, complainant Satya Devi W/O Parkash Raj R/O Bagote Jagir, lodged a written report to Incharge, Police Post, Pouni narrating therein that on 17.07.2011 at about 2:00 p:m, her unmarried daughter aged 20 years (prosecutrix, name withheld) who is illiterate, had gone to fetch water from nearby Spring adjacent to the house of her nephew Naresh Kumar. The prosecutrix went there but did not find Naresh Kumar and his wife. Accused Rakesh Kumar was sitting on the Verandah, who told her to come inside the house for a minute and the moment she went inside the room, she was raped by the accused and was threatened not to tell the same to anybody and also bolted the door from inside. Sunita Devi, who was passing from nearby, on hearing hue and cry reached on the spot and thereafter accused fled away from the spot. On this complaint, a case under FIR No.122/2011 came to be registered under Sections 376 RPC and the investigation was set in motion.
Principal Sessions Judge ReasiKamleshPandit after hearing both the sides observed that the imprisonment for seven years shall sub-serve the ends of justice Accordingly, it is ordered that for commission of offence under Section 376 of RPC, the convict Rakesh Kumar shall undergo rigorous imprisonment for seven years and a fine of Rs.10,000/-.
Court also recommended that compensation in terms of Victim Compensation Scheme, as on date, may be granted to the victim-prosecutrix. A copy of this judgment shall be forwarded to the Chairman District Legal Service Authority Reasi.
