Court rejects bail of HM OGW

Jammu, Feb 14:Special Judge (3rd Additional Sessions Judge Jammu) Subash C Gupta rejected the bail application of Zahoor Ahmed Bhat Employee of Health Dept who is Over Ground worker of HM.
Police report reveals that on 02.01.2020, an information was received by the police station, Dacchan through their reliable source that some persons particularly- Mohd Hussian son of Dullah Gujjar R/O Gujjar Kothan , Saddam Hussain Wani son of Mohd Amin Wani R/O Suid Dachhan , Ghulam Nabi Chopan, son of Abdul Aziz Chopan R/O Trungai Dachhan, Bashir Ahmed Mingnoo son of Lal Din Mingnoo R/O Khraipakhnoo, Dachhan, Wali Mohd Sheikh son of Ghulam Mohd Sheikh R/O Sewarbatti Dachhan, Mohd Ramzan son of Mir Zaman R/O Dangdoru,Yasir Hussain son of Ghulam Mohd Dar R/O Dangdoru Dachhan, Khazer Mohd son of Habib Sheikh R/O Dangdoru,Bashir Ahmed Sheikh son of Abdul Gani Sheikh R/O Sewarbatti Dachhan & Zahoor Ahmed son of Sanaullah Bhat R/O Lohrna Dachhan have established an underground network and are associated with banned Organization -Hizbul Mujahideen ( HM). It is further alleged that they are harboring, providing transportation and other logistics services to the terrorists associated with the banned Organization -Hizbul Mujahideen ( HM) for carrying out attacks against the security forces .
It is further the learnt that they are managing secret meetings with an active militants namely Mohd Amin alias Jahangir Saroori , Mudasir Ahmed & Riaz Ahmed for carrying out militants activities in the area by plotting conspiracies and providing funds to them . It is further the allegation of the police that they are providing arms and ammunition to the militants .Moreover, information with regard to locations of the security forces for carrying out attacks upon them. It is further in the police report that they by doing the afore delineated acts of omission and commission are hurting the sovereignty and integrity of the country. On the basis of this report, a Case FIR No.01/2020 for the commission of offences under sections 13,18,19, 38 & 39 UA(P) Act was registered with P/S Dacchan.
Immediate after lodging of FIR, investigation was set into motion. In its due course , the afore named persons were arrested and subjected to sustain-questioning. On disclosure of the accused Khazar 12 bore rifle was recovered, at his instance .Accordingly, offence under section 3/25 Arms Act was incorporated into the earlier registered offences. On questioning, the applicant/accused - Zahoor Ahmed Bhat referred himself as an employee of health department and confessed that the used to provide medical treatment and medicines to the militants in Renie Marwah area. Furthermore, he disclosed that once, active militant namely Jahangir Saroori at his home Loharona Dacchan and took some medicine from him . He further asked him to communicate a massage to co-accused of the instant Case FIR namely- Saddam, for arranging funds and men.
Special Judge (3rd Additional Sessions Judge Jammu) Subash C Gupta after hearing APP Sanjay Kohli for the UT observed that accusation against the applicant/accused of his involvement in unlawful activities within the meaning of relevant provisions of UA(P) Act of the banned Terrorist Organization- Hizbul Mujahideen ( HM) is serious, heinous, grave viz-a-viz security, integrity and sovereignty of Union of India and of our own, Union Territory. With these observations court rejected bail application. JNF
